1 Acceptance of Terms

Welcome to HostServerBD. By accessing or using any service provided by HostServerBD ("Company", "we", "us", or "our"), including but not limited to shared hosting, VPS hosting, reseller hosting, domain registration, bulk SMS, IP phone numbers, and VPN services, you ("Client", "User", or "you") agree to be legally bound by these Terms of Service.

If you do not agree with any part of these terms, you must immediately discontinue use of our services and close your account.

These terms apply to all users of HostServerBD services, including individuals, businesses, and resellers operating under our platform.

2 Our Services

HostServerBD provides the following services to clients in Bangladesh and internationally:

We reserve the right to modify, add, or discontinue any service at any time with or without notice. We will make reasonable efforts to inform clients of any significant service changes.

3 Account Registration & Responsibilities

To use our services, you must create an account in our client area. By registering, you agree to:

You are fully responsible for all activities that occur under your account. HostServerBD cannot be held liable for any losses resulting from unauthorized use of your account due to your failure to maintain password security.

⚠️ HostServerBD will never ask for your password via email, phone, or live chat. Do not share your password with anyone claiming to be from our support team.

4 Payment, Billing & Refund Policy

Billing Cycle: Services are billed monthly or annually depending on the selected plan. Invoices are generated and sent to your registered email address before the due date.

Payment Methods: We accept bKash, Nagad, Rocket, bank transfer, and other available payment gateways listed in your client area.

💡 Refunds are processed within 7–10 business days. Refund requests must be submitted via support ticket at my.hostserverbd.com.

Prices are subject to change. You will be notified at least 30 days before any price increase takes effect on your existing services.

5 Acceptable Use Policy

All HostServerBD services must be used in a lawful and responsible manner. You agree to use our services only for legitimate purposes that comply with all applicable laws and regulations of Bangladesh and the country of your residence.

Resource Usage: Shared hosting accounts must not:

VPS clients have dedicated resources but are still subject to network abuse policies and must not use resources to harm others or our network infrastructure.

6 Prohibited Content & Activities

The following content and activities are strictly prohibited on all HostServerBD services. Violation will result in immediate suspension without refund:

🚫 We cooperate fully with law enforcement authorities. Any illegal activities detected will be reported immediately to relevant authorities without prior notice to the account holder.

7 Uptime Guarantee & SLA

HostServerBD guarantees 99.9% network uptime for all shared hosting and VPS services, calculated on a monthly basis excluding scheduled maintenance windows.

Scheduled Maintenance: We perform scheduled maintenance during off-peak hours (typically 2:00 AM – 5:00 AM Bangladesh Standard Time). Advance notice will be provided via email and our status page.

Uptime Credits: If uptime falls below 99.9% in any given month due to our infrastructure failure (excluding third-party issues or client-caused downtime), you are eligible for:

Credits are applied to your next invoice and must be requested within 7 days of the incident via support ticket. Credits are the sole remedy for downtime and do not apply to VPS interruptions caused by the client's own configuration.

8 Suspension & Termination

HostServerBD reserves the right to suspend or terminate any account at any time for the following reasons:

Account Cancellation by Client: You may cancel your account at any time by submitting a cancellation request through your client area. Cancellations take effect at the end of the current billing cycle.

Data After Termination: Upon account termination, all data stored on our servers may be permanently deleted within 7 days. You are solely responsible for maintaining backups of your data before requesting cancellation or in the event of suspension.

⚠️ HostServerBD is not responsible for any data loss resulting from account suspension or termination. Always maintain local backups of all your data.

9 Data, Backups & Security

While HostServerBD performs periodic server-level backups for disaster recovery purposes, these backups are not guaranteed and should not be relied upon as your sole backup solution.

HostServerBD employs industry-standard security measures including firewalls, DDoS protection, and intrusion detection systems. However, no system is 100% secure and we cannot guarantee complete immunity from all threats.

10 Privacy Policy

HostServerBD is committed to protecting your personal information. We collect and process personal data as necessary to provide our services and comply with legal obligations.

11 Intellectual Property

All content, trademarks, logos, service names, and intellectual property associated with HostServerBD are the exclusive property of HostServerBD and its licensors. You may not:

You retain full ownership of all content, websites, and data you upload and host on our servers. By using our services, you grant HostServerBD a limited license to store and process your content solely for the purpose of delivering our services to you.

12 Limitation of Liability

To the maximum extent permitted by applicable law, HostServerBD and its officers, directors, employees, and agents shall not be liable for:

Our total liability to you for any claim arising under these terms shall not exceed the amount you paid to HostServerBD in the 30 days preceding the claim.

Our services are provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the fitness of our services for any particular purpose.

13 Changes to Terms

HostServerBD reserves the right to update or modify these Terms of Service at any time. When significant changes are made, we will:

14 Governing Law & Disputes

These Terms of Service are governed by and construed in accordance with the laws of the People's Republic of Bangladesh, without regard to conflict of law principles.

Any dispute, controversy, or claim arising out of or relating to these terms or the use of our services shall first be attempted to be resolved through good-faith negotiation between the parties.

If the dispute cannot be resolved through negotiation within 30 days, it shall be submitted to the appropriate courts of Dhaka, Bangladesh, which shall have exclusive jurisdiction over such disputes.

For international clients, you agree that Bangladesh law governs your use of our services regardless of where you are located.
